AI is becoming easier to add to websites, portals, intake forms, staff tools, and internal workflows. But in healthcare, easy does not always mean appropriate.
Before adding AI to a healthcare-related system, the first question should not be “Which model should we use?” A better starting point is: what data will this feature touch, and who is responsible for it?
If an AI workflow may involve Protected Health Information (PHI), the safest approach is to slow down and map the system before launch. That does not mean every AI idea is off limits. It means the workflow needs to be understood clearly enough for the organization, its Privacy Officer, Security Officer, vendors, and legal/compliance advisors to evaluate it.
AI does not replace the HIPAA basics
AI does not create a shortcut around HIPAA. If PHI is involved, the same practical questions still matter:
- Where does PHI enter the system?
- Is PHI displayed, transmitted, stored, cached, logged, or exported?
- Who can access the feature and the data behind it?
- Which vendors or APIs receive information?
- Is a Business Associate Agreement needed?
- Are prompts, responses, errors, and support logs handled safely?
- Can the organization explain the data flow if something goes wrong?
These questions are not just legal questions. They are web architecture questions. A poorly designed form, API call, session, log file, chatbot, or document upload flow can create risk even when the intent is reasonable.
Where AI adds extra concern
AI features often process more context than a traditional form field or database query. A chatbot may receive free-text patient questions. A document tool may summarize records. A staff assistant may search internal notes. A model may generate an answer based on retrieved documents.
That makes the surrounding system just as important as the model itself. The main concerns usually include:
- Inputs: What exactly is sent to the AI tool?
- Retrieval: What records, files, or notes can the system search?
- Outputs: Could the answer reveal information to the wrong person?
- Logs: Are prompts, responses, errors, or debug traces storing PHI?
- Vendors: Does the vendor support the intended healthcare use case and offer a BAA where required?
- Retention: How long are files, prompts, responses, and audit records kept?
In many cases, the best first step is not building the AI feature. It is documenting the workflow well enough to decide whether the feature should exist in that form at all.
What HHS activity signals
HHS has proposed updates to the HIPAA Security Rule that would strengthen cybersecurity expectations for electronic PHI. The proposal discusses AI-related data issues, including ePHI used in training data, prediction models, and algorithm data maintained by regulated entities for covered functions.
The practical takeaway is modest but important: AI tools that interact with PHI should not be treated as casual side experiments. They should be part of the organization’s technology inventory, risk analysis, vendor review, and security planning.
A practical consulting approach
For most organizations, the useful work starts with a focused technical review. That review should identify:
- what the proposed AI feature is supposed to do,
- what data it needs,
- whether PHI is involved,
- where the data travels,
- which vendors are in the chain,
- what is logged or retained,
- what access controls are needed, and
- what questions should be escalated to the organization’s compliance officer or counsel.
That kind of review does not magically make a system “HIPAA compliant.” No single developer, vendor, plugin, or API can promise that by itself. HIPAA compliance depends on the full environment: policies, contracts, workforce access, risk management, incident response, vendor relationships, and technical safeguards.
But a technical review can prevent obvious mistakes before they become expensive problems.
